You agree to provide true, accurate, current, and complete registration information and to keep it updated. FXer reserves the right to suspend or terminate accounts that provide false or misleading information.
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use FXer. By using the Platform, you represent and warrant that you meet these requirements.
Under EU law, you have a 14-day right to withdraw from this contract without giving any reason. However, because our service begins immediately upon subscription, you expressly consent to immediate performance and acknowledge that you lose your right of withdrawal once the service has been performed. You may cancel your subscription at any time via your Stripe billing portal.Users are responsible for canceling subscriptions if they no longer wish to continue.Refunds for the current billing period are at FXer's sole discretion and are not guaranteed.
FXer is a trade tracking and analytics tool for informational and educational purposes only. FXer is not a registered broker-dealer, investment advisor, or financial analyst. Nothing on the Platform constitutes investment advice, a solicitation, or a recommendation to buy or sell any financial instrument. You assume all risk for trading decisions made based on information displayed on the Platform. You should consult your own financial advisor before making any trading decisions.
FXer reserves the right to suspend or terminate accounts that violate these Terms, with reasonable notice where practical. Upon termination, your right to access the Platform ceases immediately.
You are responsible for all content you upload and for maintaining account security.You must keep backup copies of your data. FXer is not responsible for data loss.
FXer provides Expert Advisors (EAs) and integration tools for MetaTrader 4, MetaTrader 5, and cTrader. These tools are provided "as is" and are designed solely to export your trading data to FXer. They do not execute trades, modify orders, or interfere with your trading activity. You are responsible for installing and configuring EAs correctly. FXer is not liable for any trading losses, platform issues, or data corruption resulting from EA installation or use.
API tokens grant access to your FXer account for automated data uploads. You are responsible for keeping API tokens confidential and secure. Any data uploaded using your token is your responsibility. You must revoke tokens immediately if you suspect unauthorized access. FXer is not liable for unauthorized access resulting from compromised tokens.
FXer community features allow users to share trading accounts, statistics, and signals. FXer does not verify, endorse, or guarantee the accuracy of any user-shared content. You assume all risk when acting on information shared by other users. FXer is not liable for losses resulting from reliance on community content.
All software, branding, and designs are the exclusive property of FXer.Users may not copy, reproduce, or distribute materials without consent.
When you publish Content publicly on the Platform, such as sharing your trading accounts, statistics, or journal entries, you grant FXer a worldwide, non-exclusive, royalty-free, sublicensable license to display, distribute, and make your public Content available to other users. You retain ownership of your Content and may remove it from public view at any time.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. FXer does not guarantee that the Platform will be uninterrupted, error-free, secure, or free of viruses. Use of the Platform is at your own risk.
FXer provides tools for trade tracking and analytics, but does not guarantee uninterrupted service or provide investment advice.To the fullest extent permitted by law, FXer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Platform.
FXer's total liability to you for any claims arising under these Terms shall not exceed the fees you paid to FXer in the 12 months immediately preceding the event giving rise to the claim. This cap does not apply to liability for death, personal injury, fraud, or any liability that cannot be limited under applicable law.
FXer may display market data, news, and other information obtained from third-party sources, including but not limited to Dukascopy and similar providers. FXer does not guarantee the accuracy, completeness, or timeliness of third-party data and is not responsible for any errors or omissions. Such data is provided "as is" for informational purposes only.
The Platform may contain links to third-party websites or services, including brokers, trading platforms, and external resources. FXer does not control, endorse, or assume responsibility for any third-party content, privacy policies, or practices. You access third-party links at your own risk.
FXer reserves the right to modify, suspend, or discontinue any aspect of the Platform, including features, pricing, and availability, at any time. FXer will provide reasonable notice of material changes where possible, but shall not be liable for any modification, suspension, or discontinuation.
You agree to comply with all applicable export control laws and economic sanctions regulations, including those of Estonia, the European Union, and the United States. You represent that you are not located in a jurisdiction subject to comprehensive sanctions or designated as a sanctioned person or entity.
You agree to indemnify and hold harmless FXer against claims resulting from your use, content, or violations of these Terms.
FXer shall not be liable for events beyond its reasonable control, such as natural disasters, cyberattacks, or government actions.
FXer may send alerts regarding account balance, drawdown, connectivity status, and other metrics. Alerts are provided for informational purposes only and are not guaranteed to be timely, accurate, or complete. You should not rely solely on alerts for trading decisions or risk management. FXer is not liable for losses resulting from missed, delayed, or inaccurate alerts.
FXer respects intellectual property rights and expects users to do the same. If you believe content on the Platform infringes your copyright, send a notice to the contact address listed at the end of these Terms with: a physical or electronic signature of the copyright owner or authorized agent, a description of the copyrighted work, the location (URL) of the allegedly infringing material, your contact information, a good-faith statement that the use is not authorized, and a statement under penalty of perjury that the information is accurate. FXer will remove infringing content and may terminate the accounts of repeat infringers in appropriate circumstances.
If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
These Terms, together with the Privacy Policy, Cookie Policy, and any applicable Data Processing Agreement, constitute the entire agreement between you and FXer regarding your use of the Platform. They supersede any prior agreements, communications, or understandings, whether written or oral.
FXer's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by FXer to be effective.
You may not assign or transfer your rights or obligations under these Terms without FXer's prior written consent. FXer may assign or transfer these Terms in connection with a merger, acquisition, or sale of substantially all of its assets.
If you access FXer from outside the EU/EEA, your data may be transferred internationally.We use safeguards such as EU-approved Standard Contractual Clauses (SCCs) with processors like Stripe and Google to ensure GDPR compliance.
FXer does not use your trading data, Content, or any user-uploaded information to train machine learning models or artificial intelligence systems. Any AI features on the Platform operate solely on your data within the context of your session.
In accordance with the EU AI Act (Regulation 2024/1689), FXer informs you that certain features of the Platform, including the FXer Lens assistant, are powered by artificial intelligence. You will be notified when interacting with AI features. FXer Lens provides analytical summaries of your trading data and does not make trading decisions or provide financial advice.
As a hosting service provider under the EU Digital Services Act (Regulation 2022/2065), FXer provides a mechanism for users and authorities to report illegal content. To report content you believe violates applicable law or these Terms, contact us using the details provided at the end of these Terms. FXer may remove content and suspend accounts in response to valid reports, in accordance with applicable law.
In the event of a personal data breach, FXer will notify affected users and the relevant supervisory authority within 72 hours of becoming aware of the breach, in accordance with GDPR Article 33.
Users in the EU have the right to access, correct, delete, or restrict processing of their data.You may request a copy of your data or withdraw consent for processing at any time.
You retain full ownership of all Content and trading data you upload to FXer. By uploading Content, you grant FXer a limited, non-exclusive, royalty-free license to process and display your Content solely for the purpose of providing the Services to you.
Upon account cancellation, your data remains available for export for 30 days. After 30 days, your data is permanently deleted from our systems. You may request earlier deletion by contacting us.

These Terms are governed by and construed in accordance with the laws of Estonia.Any disputes shall be resolved exclusively in the courts of Estonia.
FXer may update these Terms from time to time. Material changes will be communicated to you via email at least 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may cancel your subscription before they take effect.
